QLD:Dissent in Queensland Party over merger

One of the founders of the Queensland Party says he's "considering his options" to
keep the political entity alive, after party leader AIDAN MCLINDON announced a merger
with BOB KATTER'S Australian Party.

JIM NICHOLLS wrote the party's constitution and is its candidate for the seat of Mt Isa.

He's expressed concern over the merger, saying the national focus of the Australian
Party will reduce the focus on Queensland's interests.

NSW:Sixth NSW road death lifts Xmas toll to 27

The New South Wales holiday road toll has risen to six with the death of a 27-year-old
man in Sydney's southwest.

Police say he was thrown from his car and killed about 7.30 last night when he veered
off Bensley Road at Ingleburn and crashed into a large boulder.

Later in the night a three-car crash on the F3 freeway at Wahroonga in Sydney's north
left an elderly couple in critical condition in hospital.

Victoria heads the national holiday road toll with 10 dead .. Queensland has seven
.. NSW six .. Western Australia two .. and the ACT and Tasmania one each.

* International aid agencies and the Pakistani government have warned that outbreaks
of disease and escalating starvation from the country's worst floods on record could lead
to countless more deaths and drive support for the Taliban. Foreign Minister Stephen Smith
says Pakistan will overcome its security problems when its economic situation strengthens,
which is why Australia has decided to increase its aid budget for the country following
the disastrous floods.

* Prime Minister Julia Gillard has expressed her support for an Australian republic,
but says due to the strong national ties to Queen Elizabeth the time for a changeover
should come when switching monarchs. Speaking in the marginal seat of Herbert, Ms Gillard
dodged tricky questions about the national broadband network and restated her challenge
to Opposition Leader Tony Abbott for a debate on the economy.

* Many health professionals have expressed disappointment at what they perceive is
Labor and the coalition's major policy focus on hospitals in their health reforms at the
expense of primary and community care. Mental health advocates say the coalition has the
support of many in the industry as its committed the most money to mental health, whereas
the government has simply promised to introduce a new scheme within its term without offering
any specifics.

Qld: Storm bill tops $1 billion

BRISBANE, April 15 AAP - The bill for Queensland's six-month onslaught of cyclones
and storms is set to soar above $1 billion.

The storm season began in earnest in November, when southeast Queensland and areas
west of Brisbane were hit by massive winds and flooding rains.

A shell-shocked Prime Minister Kevin Rudd said at the time the worst-hit area of The
Gap looked like a "war zone", while Premier Anna Bligh likened it to Cyclone Larry, which
caused almost $1 billion in damage when it hit Innisfail, in the state's far north, in
March 2006.

In its latest estimate, the Insurance Council said at least 34,000 claims had been
made by southeast households, with a pricetag of $309 million.

In January and February, cyclones Charlotte and Ellie ravaged north Queensland.

Charlotte crossed the coast in the Gulf of Carpentaria on January 12 while Ellie crossed
near Mission Beach in the early hours of February 2.

The gulf communities of Normanton and Karumba were under water for weeks, while Townsville
and the north Queensland town of Ingham suffered the worst damage along the eastern coast.

Around $180 million in insurance claims have been lodged by north Queensland residents,
with the overall damage bill to homes and businesses estimated to be around three times
this.

In the gulf, the state and federal governments spent $1 million on fodder drops to
5,700 stranded cattle and offered low interest loans to farmers, as well as establishing
a task force to help cattlemen re-establish after the floods.

"While some areas will take longer to recover, much of the gulf is now looking magnificent
and we anticipate some productive years ahead," Member for Mount Isa Betty Kiernan says.

Emergency Services Minister Neil Roberts said the latest bill for damage to infrastructure
and assistance payments had been assessed at $330 million.

The damage spanned 40 local government areas, across more than 60 per cent of the state.

"The vast majority - $314 million - of the estimated damage bill is the cost of restoring
damaged public infrastructure like roads and bridges that were damaged during the floods,"

Mr Roberts told AAP.

"The remainder is made up of assistance paid to residents who suffered personal hardship
and concessional loans and freight subsidies made available to primary producers and small
business owners."

Mr Roberts said the costs were being shared between the state and federal governments.

The most recent heavy rain on the Sunshine Coast, which worst affected the northern
end of the coast around Kin Kin and Noosa, caused $3.79 million in infrastructure damage,
Mr Roberts said.

The storms have also triggered an estimated $1 million in insurance claims.

A Suncorp insurance spokeswoman told AAP the past three years had been tough in terms
of the frequency of severe weather events and associated insurance claims.

FED: Police officer, QC part of child abuse network

A retired QC from Victoria .. a police officer from New South Wales and a childcare
worker are among people arrested as part of an investigation into a global internet child
abuse ring.

More than 15-thousand videos and 500-thousand images of child abuse have been seized
as a result of the 12-month investigation.

Police say the images are among the worst they have seen .. and involve children as
young as 12 months old.

The investigation .. dubbed Operation Resistance .. has so far resulted in the arrest
of 19 men across New South Wales .. Victoria and Queensland .. and more arrests are expected.

Two children in NSW had been removed from contact with alleged offenders.

Retired 74-year-old QC .. NEIL JAMES WILLIAMS .. of Newham in central Victoria .. is
one of the people facing child pornography charges as part of the investigation.

NT: Bob Collins took own life, coroner finds

The Northern Territory Coroner has found former Labor senator and alleged paedophile
BOB COLLINS .. took his own life using a combination of prescription drugs and alcohol.

Mr COLLINS died at the age of 61 .. three days before he was due to face court on child
sex abuse charges dating back 30 years.

The charges included possessing child pornography .. indecent assault .. carnal knowledge
and sexual intercourse without consent.

His death last September followed a long battle with bowel cancer .. which had delayed
legal proceedings against him.

In a statement issued today .. Northern Territory Coroner GREG CAVANAGH said the former
senator had taken his own life.

NSW: Paramedics may strike during APEC, unions warn

New South Wales ambulance officers may walk off the job during next month's APEC summit.

Their union claims the latest pay offer from the state government is insulting.

The Health Service Union says ambulance officers have waited two years for a pay deal
.. and have been presented with an offer which will leave most of them worse off .. some
by 88 dollars a week.

Union members will meet next Saturday to decide their next step.





HSU general-secretary MICHAEL WILLIAMSON says a strike next week is entirely possible.

He says it can't be ruled in .. or out.

Mr WILLIAMSON says the ambulance service has failed to ensure sufficient staff to meet
usual requirements.

He says the situation will only be made worse during a major event like APEC.

Vic: Video abuse scandal now embroils elite school

Melbourne's prestigious Xavier College has been embroiled in a new scandal .. this
time over a video of classmates kicking .. pushing and taunting a 15-year-old fellow student.

A relative of the victim says he believes police will begin investigating the source
of the video today.

News Limited papers report the bullying was filmed last October by another student
on a mobile phone .. and was distributed to others via other phones and the internet.

It was also briefly uploaded to the YouTube video sharing website.

Five Xavier students have been suspended over the incident .. which the college's development
director GRAHAM SHARP describes as a prank that got out of hand.

Two days ago it was revealed one Xavier student was expelled for allegedly selling
marijuana at the school .. while others had been suspended for allegedly buying it.

The Victorian opposition says land tax bills for small businesses are soaring .. despite
promises by the government.

Opposition Leader ROBERT DOYLE says property owners will be faced with an average increase
of 20 per cent when they receive their assessments.

Mr DOYLE has told reporters at a dry cleaners in the Melbourne suburb of Camberwell
.. the owner is being forced to sell .. because his land tax has risen from 813 dollars
in 1999 to 19 thousand this year.





Premier STEVE BRACKS says the government has already provided significant land tax
relief and any rises are due to a rise in property values.

The Department of Foreign Affairs and Trade says an alleged kingpin of the Bali Nine
once worked in its Sydney passports office but wasn't involved in the authorisation of
passports.

A DFAT spokesman says it employed Sydney martial arts expert 24-year-old Myuran Sukumaran
as a temporary employee in its Sydney passports office for five months in 2000.

The spokesman says he was employed in a junior support role and wasn't involved in
authorising passports.

And he says he passed the usual police checks.

Indonesian police say Sukumaran was the head of the group of nine Australians trying
to smuggle 8.65kg of heroin from Bali into Australia.

All nine face the death penalty.

Yesterday Indonesian authorities revealed several of the Bali nine had travelled to
to the country in the past, using multiple fake passports.

The purchase of AT&T Corp. by SBC Communications Inc. saves AT&T from a nosedive into irrelevance in the industry it created more than a century ago. It also gives SBC the name and the network to fulfill its goal of being viewed as a truly national player rather than just a local telephone company.

The $16 billion (euro12.3 billion) marriage of long-bitter rivals, which may take until mid-2006 to clear intense regulatory scrutiny, would add long distance and business services to the list of markets where SBC holds a dominant role. It is already the first or second largest U.S. provider of local calling, wireless and Internet services.

The deal announced Monday also sparks immediate speculation as to whether two other largely regional powers, Verizon Communications Inc. and BellSouth Corp., will need to keep pace by purchasing MCI Corp. for its national network infrastructure and roster of corporate clients.

While both SBC and Verizon are by now far larger than New Jersey-based AT&T on many fronts, the business customers served by AT&T and MCI include far more major corporations with national communications needs. Many of those customers are hesitant to switch providers for a lifeline as vital as communications, making it hard for the Bells to lure away AT&T's clients.

For that reason, SBC made clear that the globally recognized AT&T brand name would not disappear as a result of the deal.

The companies declined, however, to say whether the AT&T name might be used for specific services or possibly even replace SBC, which formerly stood for Southwestern Bell Communications and therefore carries some non-national connotations which Texas-based SBC has strived to leave in the past.

"We obviously need a few days to figure all this out because this (deal) came together kind of quick," Edward E. Whitacre Jr., SBC's chairman and chief executive, said in a conference call.

"But," he stressed, "It's a great name. It's not going away."

While it's doubtful the valuable AT&T brand would ever have been abandoned, AT&T the company has been rapidly decaying as a viable business for five years, battered by multiple financial traumas.

First came an overpriced binge of acquisitions in the cable TV industry designed to give AT&T its own direct wire into the homes of consumers for the first time since it was forced to spin off its local phone lines in 1984, creating Southwestern Bell and six other "Baby Bells."

Then came the collapse of the technology bubble and its briefly insatiable demand for telecommunications services; criticism over its inability to match the fraudulent numbers being reported by WorldCom (now MCI); and regulatory changes that will end AT&T's ability to lease local Bell lines at low government-set rates.

AT&T's revenues have been on a steady slide, from nearly $50 billion in 1999 to $30.5 billion (euro23.4 billion) in 2004. Its residential customer base has fallen from a peak of 60 million to about 24 million at the end of last year. In their quarterly update two weeks ago, AT&T executives declined to suggest either trend might end any time soon.

The agreement calls for each share of AT&T to be purchased for SBC stock worth $18.52 at Monday's price, plus a cash payment of $1.30, for a total value of $19.82 per share.

That represents little premium over AT&T's share price, which rose sharply last week amid reports a deal with SBC was being discussed. In Monday's trading, AT&T shares fell 52 cents, or 2.6 percent, to $19.19 on the New York Stock Exchange. SBC's shares rose 14 cents to $23.76 on the NYSE.

In addition the deal would leapfrog SBC past Verizon Communications Inc. in terms of revenue. Combined, SBC and AT&T would have had $90.6 billion (euro69.5 billion) in revenues in 2004, if adjusted to reflect SBC's proportionate 60 percent share of the Cingular Wireless venture it owns with BellSouth Corp.

Verizon's revenues would total about a third less than that if adjusted to reflect its proportionate 55 percent share of its Verizon Wireless partnership with Vodafone Group PLC.

Versata, Inc. (Nasdaq: VATA), a provider of software and services that automate the development, deployment and change management of transaction-based e-business, today released its results for the fourth quarter and fiscal year ending December 31, 2000.

Total revenues for the quarter ended December 31, 2000 were $16.7 million, an increase of 224% from $5.2 million for the same period in 1999 and a decrease of 5% from $17.6 million for the third quarter 2000. The pro forma net loss, which excludes non-cash stock compensation charges, amortization of goodwill, and other non-operating expenses, was $11.9 million or $0.30 per share, compared to a pro forma net loss of $6.6 million or $0.22 per share for the fourth quarter 1999 and $7.8 million or $0.20 per share for the third quarter 2000.

Fourth quarter software license revenue grew 220% from fourth quarter 1999 and 12% sequentially to $9.6 million, from $3.0 million and $8.6 million, respectively. Professional services revenues and support fees were $7.1 million. As a percent of total revenue, software license revenue increased to 57.3% in the fourth quarter 2000 from 48.7% last quarter.

For the year 2000, total revenues reached $58.3 million, an increase of 363% from $12.6 million in 1999. The pro forma net loss, which excludes non-cash stock compensation charges, amortization of goodwill, and other non-operating expenses, was $37.7 million or $1.00 per share, compared to a pro forma net loss of $17.8 million or $0.72 per share in 1999.

In the fourth quarter, Versata earned a gross profit of $7.2 million, up 168% from $2.7 million earned in the fourth quarter of 1999, and down 18.2% from $8.8 million in the prior quarter. Gross profit for the year 2000 was $26.6 million, an increase of 345% from 1999.

Versata ended the fourth quarter with $74.4 million in cash and short-term securities. The days sales outstanding (DSO) was 87 days at the end of the quarter, compared to 72 days in the third quarter 2000. Deferred revenue was $9.0 million at the end of the quarter, a 12.1% increase from the prior quarter figure of $8.0 million.

New Customers and Partners

Versata added 39 new domestic and international end-use customers in the fourth quarter, including:

-- Domestic: Children's Hospital of Cincinnati, Fireman's Fund, Force 10 Networks, Kemper Insurance, L.A. County Mental Health, Meridien Health Care, Raytheon, TAL Technologies, and Yalta Communications.

-- International: ADDECO/Cenergys, ALCATEL, British Telecom, Compagnie Francaise de Methane (CFM), Chantiers De L'Atlantique, CNASEA, France Telecom, KLM, Novaxess, and Wesdeutsche Landesbank.

In the year 2000, over 150 new end-use customers began using the Versata system, bringing the total to nearly 500.

In the fourth quarter 2000, 24% of Versata's customers were repeat end-users and value-added resellers. These included Colt Telecom, InvestorsPlus, Koch Petroleum Canada, Manitoba Blue Cross, Nekema, and Viewtrak Technologies.

Versata signed new agreements with system integrators and value-added resellers such as Aegis/Aetrex, Datanomix, Neasi-Weber International, Nextance, Solution Bank and Xenium. Also, Versata trained over 270 developers in the fourth quarter. Approximately 1,300 developers were trained in the year 2000. Enhancing chemical management within the framework of existing TSCA regulations.(MANAGING COMPLIANCE)(Toxic Substances Control Act)

In the last 2 years, momentum has been building for significant reform of the Toxic Substances Control Act (TSCA). In September 2009, EPA Administrator Lisa Jackson released a set of core principles to strengthen U.S. chemical management laws. Shortly thereafter, in April 2010, Senator Frank R. Lautenberg, D-N.J., introduced legislation to overhaul TSCA, dubbed the "Safe Chemicals Act of 2010."

While it recently was speculated that a divided House and Senate would prevent any TSCA legislation from passing in 2011, a Feb. 3 Senate hearing to assess the effectiveness of U.S. chemical laws revealed that there still is strong support for TSCA reform.

"We are committed to being part of a bipartisan process to achieve modernization of TSCA," said Cal Dooley, president of the American Chemistry Council, an industry group.

However, the path to reform likely will take some time. Even if a bill is passed this year, EPA still will need to so through a rulemaking process to promulgate any resulting regulations. This process could take some time, so any changes to the current chemical control law still are several months, if not years, away.

With this in mind, EPA has been working hard to enhance chemical management within the scope of the current TSCA regulations. A summary of these changes follows.

UNDERSTANDING ENHANCEMENTS

Following the 2009 announcement, EPA has been hard at work modernizing TSCA through the existing limits of the law. To date, they have released eight chemical action plans and are in the process of completing two more. The chemical action plan (CAP) indicates that the agency will be taking regulatory action through TSCA 5Ca)(2), 5(b)C4) and 6(a) to increase requirements, restrict or ban numerous chemicals. Other notable enhancements include:

* In January 2010, EPA announced that it would review confidentiality claims submitted under TSCA 8(e) to enhance the public's access to "critical health and safety information on chemicals." Following this announcement, EPA published a statement that announced that it generally would deny confidentiality claims for the identity of chemicals in health and safety studies filed under TSCA "except in specific circumstances" and that confidential business information (CB1) was to be rejected.

Chemicals affected by this action are those submitted to EPA with studies that show a substantial risk to human health and the environment and that previously have been disclosed on the TSCA Chemical Inventory. Under TSCA, companies may claim a range of sensitive, proprietary information as CBI. Under Section 8(e), companies that manufacture, process or distribute chemicals are required to immediately provide notice to EPA if they learn that a chemical presents a substantial risk of injury to health or the environment. Section 8(e) reports are made available on EPA's Web site. Until now, companies routinely claim CBI. The new policy will increase the amount of information available by granting public access to the chemical identification information submitted, along with other health and safety data under Section 8(e).

* An announcement was made in May 2010 that EPA has performed a pilot program reviewing CBI claims submitted within the past 5 years. On Feb, 10, EPA notified five companies that 14 chemicals for which they had submitted confidential health and safety studies would be made public on the 31" day after the company receives the determination.

* On Feb. 25,2010, EPA published a proposed rule requiring testing on 29 high production volume chemicals. Following a public meeting in August 2010, a final rule was published Jan. 7 requiring manufacturers to submit data on 19 substances. This group of chemicals targets a wide variety of consumer and industrial chemical products. Data collected through TSCA Section 4 will allow EPA to obtain critical information and develop plans to mitigate risks as well as increase transparency by providing hazard characterizations to the general public.

EPA also has made changes to IUR reporting to increase transparency and frequency. The rule currently states that reporting must occur every 5 years, but the proposed rule requires reporting every 4 years. This would provide consumers with an increased ability to determine which chemicals are being produced in their vicinity. The proposal also mandates electronic reporting, so the information will be available to the public faster and on a more consistent basis.

* In March 2010, EPA launched its TSCA chemical inventory for free on the Web. This especially is notable as this is the first time that this inventory has been offered for free, and is part of a series of ongoing steps he agency is taking to empower the public with important information. The inventory contains a consolidated EPA list of thousands of industrial chemicals.

* In May 2010, EPA added 6,300 chemicals and 3,800 facilities to the Envirofacts database, which is Internet accessible and provides information about environmental activities that may affect air, water and land The database also provides tools for analyzing the data and includes facility name and address information, an aerial image of the facility and surrounding area and the map location of the facility. In addition, the database links to other EPA information on the facility, such as EPA's inspection and compliance records that are available through the Enforcement Compliance History Online (ECHO).

* The December 2010 availability of the Chemical Data Access Tool, which is used to find health and safety data that has been submitted to the agency under authorities in sections 4,5 and 8 of TSCA. Some of this data is being provided to the general public for the first time with the hopes that as the agency collects more information the search tool will continue to grow and will help to streamline access to a broad range of chemical health and safety data.

* On a state level laws have been passed to phase out or ban specific substances; proposed comprehensive chemical state initiatives and even resolutions from states calling on congress to reform TSCA.

EXPLORING THE IMPACT ON BUSINESS

Many companies will be affected by these changes, as almost every business involved in the chemical industry is impacted by TSCA in some way (with some exceptions among food, drug, cosmetic, nuclear and pesticides companies). In addition, raw materials, intermediates and finished goods are regulated by TSCA. Full lifecycle, or cradle-to-grave, compliance is an essential component of TSCA, and most manufacturing/importing, processing and disposal activities are TSCA regulated. If companies do not comply with TSCA, they could face severe legal repercussions, including criminal and civil penalties, damage to the brand or company reputation and negative impact on a company's ability to do business. Personnel that demonstrate willful and knowing non-compliance also face imprisonment.

The risk of financial damage also is high if a company is non-compliant, as non-compliant companies may receive fines and penalties and experience a loss of business revenue if production is stopped.

The penalties for non-compliance are severe, and companies found to be non-compliant can face penalties up to $37,500 per day or imprisonment for up to 1 year, or both. There also is a 5-year statute of limitations, and criminal penalties for "knowing" or "willful" violations can be imposed in lieu of, or in addition to, civil penalties.

In addition, as more and more states pass legislation to ban or restrict chemicals on a case-by-case basis, industry will continue to be burdened by this patchwork of regulations that ultimately will have a negative affect on development, production and sales. Currently, states are preempted by TSCA authority, but it has been proposed to remove this provision. This would allow states to impose different requirements from that of the federal act. A lack of regulatory uniformity could be quite burdensome to industry.

PREPARING FOR IMMINENT CHANGE

To ensure compliance with TSCA, experts recommend developing and maintaining a comprehensive and detailed plan, which should include the following:

* Checking the TSCA inventory for substances imported or manufactured, including the ingredients in finished products;

* Reviewing individual state regulations for banned or restricted substances;

* Reviewing TSCA R&D exemption requirements and setting up procedures to govern related activities;

* Obtaining import certification once the status of the substance or product to be imported has been checked against the TSCA inventory;

* Establishing processes for tracking 12(b) exports and assisting with export notification;

* Establishing processes for compliance with adverse effects reporting and recordkeeping;

* Monitoring and tracking regulatory changes that are likely to impact business; and

* Maintaining required records and auditing against various recordkeeping requirements. Chemical companies also should consider becoming more involved in the reform movement, possibly through industry association such as SOCMA, the ACC or SCHC.

It also is important to note that legislators are beginning to take action on a state level and that many bills are passing quickly and quietly on this level. While the promulgation of the Safe Chemicals Act would ensure some consistency on a federal level, many states now are passing the various elements of the act on an individual basis. It is imperative for companies to closely monitor the chemical control laws for the states in which they conduct business.

We need a comprehensive plan to foster a democratic transition in Cuba.(Commentary)(Editorials)(Letters)

If you haven't figured it out, Fidel Castro continues with the same party line: "There is one party here, and I am giving it." For those of you who think Cuba is opening up to the outside world, think again.

As soon as we think that Mr. Castro is ready to open up to democratic changes in Cuba, he starts the party again, except this time his party included downing two American civilian unarmed aircraft and jailing more than 100 dissidents. Last year, it was the sinking of the tugboat 13 de Marzo, in which 41 men, women and children drowned after the tugboat was rammed by Cuban coast guard vessels. What's next?

It appears that our Cuba policy is based on the rock-throwing concept: Mr. Castro throws a rock, and we duck, except this time the rock struck two civilian aircraft, killing four Americans on board. And our response - a tougher embargo. It's a good start, but how will Cubans know that our intentions are good?

We could let them know in many different ways, as Adrian Karatnycky and Frank Calzon suggested in their March 4 Op-Ed article "Dealing with Fidel." They advocate using TV, radio, periodicals and the Internet to promote democratic and free-market values to counter the communist propaganda machine that will eventually put U.S. Cuba policy on the bottom of the pile.

If we are not willing to have a comprehensive program for a peaceful democratic transition in Cuba, including the promotion of freedom, as mentioned by Mr. Karatnycky and Mr. Calzon, then let's sit back and wait for the next rock and hope that it doesn't hit us or our loved ones.

US and Honduran coastguard patrol boats have seized 4.6 tonnes of cocaine stowed aboard a ship in the Caribbean Sea north of Honduras, said the Honduran commander of the maritime raid. The cocaine shipment apparently originated from Colombia and the seizure dealt "a harsh blow to drug trafficking" operations in the region, said Captain Juan Pablo Rodriguez.

DOES THE 'CSI EFFECT' SWAY JURORS?

Associate professor of law and juries expert Thaddeus Hoffmeister explains in a CNN.com opinion titled "Did 'CSI' effect sway Anthony jury?" that programs such as CSI: Crime Scene Investigation are thought by many prosecutors and legal analysts to create unreasonable expectations for jurors deciding fates in the real world.

Within the first six hours of being posted, the article received more than 290 comments and nearly 400 Facebook recommendations.

Hoffmeister further explains in the piece, "Prosecutors have long argued that the CSI effect is real and creates unreasonable expectations in the minds of jurors. They maintain that the standards for obtaining a conviction these days have been raised because jurors now expect and want scientific evidence linking the defendant to the crime, especially in a circumstantial case. To combat this problem, many prosecutors try to lower the bar during jury selection by telling potential jurors not to expect what they see on television to be played out in the courtroom."

Hoffmeister, author of the Juries blog, also looks at how social media and the Internet are affecting juries and the outcomes of cases. Within the past few years, Hoffmeister said, jurors have taken to the Internet to divulge details of cases and conduct their own investigations.

"Judges instruct jurors not to go to the crime scene or to the jail to see if someone is there, or talk about the case," Hoffmeister said. "But now jurors can go to Google Earth and see the crime scene. They can get on the county or city website to see who is incarcerated. And, since MTV's Real World has come out, you have a generation who want to tell the world what they're doing at all times."

To help combat juror curiosity or confusion, Hoffmeister suggests allowing jurors to ask questions during the case. Another tactic Hoffmeister suggests is "virtual sequestration."

"It's cheaper than (the traditional) physical sequestration, and it's better for jurors rather than being in a hotel," Hoffmeister said.

What would Hoffmeister tell jurors to do if he were a judge: "It's natural to be curious. There's nothing wrong with being curious. Just don't act on that curiosity. You are open to penalties. Consider the parties involved. Your actions could cause a mistrial. The state and the parties involved have to continue to pay for a new trial. The mother of the victim could have to testify again. I'm not asking you to give up the Internet for the rest of your life, just while you're on jury duty."

Hoffmeister has been enthralled with jury dynamics since law school. After law school, he clerked for a judge working on trying to improve the way juries work.

"Judging your peers is an amazing power to give everyday citizens," said Hoffmeister, whom The Wall Street Journal, Chicago Tribune and The Washington Post have quoted in stories about juries. "Outside of voting, it may be the second-biggest thing in a democracy. "

Nexus Productions made its name in animation but is now branching out into the interactive arts, with new roster of artists skilled in creating everything from iPhone apps to large-scale installations

Over the last decade, as the advertising industry has adjusted to the seismic changes wrought by the internet and digital media, various new agency models have been mooted as observers have become used to talk of 360 degree thinking, integrated communication and other somewhat painful buzzwords. By contrast, production companies, so vital in the creative process, have remained curiously static. Certain production companies have launched experimental arms to explore the creation of projects that fall outside the traditional film and animation remit, but the core of the business has continued using the established model of representing directors and creating TV ads, resisting the slow encroachment of digital on the medium's territory. But changes are afoot.

Certain production companies are at last making a concerted commitment to exploring wider creative possibilities than just TV. One of these, Nexus Productions, has launched a whole new roster devoted to such a concept, under the moniker Nexus Interactive Arts. As its name suggests, the artists represented by NIA are united by an interest in interactivity, whether that be in the form of web projects, experiential installation works, mobile phone apps or live events.

NIA launched quietly a year ago and feels like a natural progression for the company, which has established an excellent reputation for its animation work. Founder Chris O'Reilly saw a parallel between the development of interactive arts and that of 3D animation in the 90s. "It reminded us a lot of when we started in animation," he says. "In the early 90s, lots of people were doing things in 3D but they were very much tech-driven people, because you needed a certain amount of technical expertise in order to actually interface with the software. Then during the mid-90s, 3D started to go through this tipping point, from being a technical medium to being an artist's medium, and at that point it became a really interesting thing for us. There was suddenly this emerging generation of early 3D animators.

"I think we saw a parallel in interactive arts," he continues. "It is obviously a field where a lot of interesting stuff has been done, but largely as a kind of technical exercise, and it just felt to us that we were looking and seeing emerging artist's voices, people who are technically literate enough to bring an artistic agenda to that area. That's when we felt that Nexus could have an impact. We've always been quite a technical company - there's a 3D studio, we effectively have our own post-house within the building, and we're not afraid of creativity and tech meeting. But creativity's always been our story, not tech."

NIA currently represents four sets of interactive artists, three teams - Hellicar & Lewis, Minivegas, Roel Wouters & Jonathan Puckey (the latter created this month's cover) - and one individual, Quayola. The company is also working with a number of artists - including Champagne Valentine and Theo & Emily - on one-off projects and is looking to expand the roster over the next year. Unsurprisingly, Nexus's animation directors are also keen to explore the opportunities that NIA brings to the company too. But despite this crossover, O'Reilly stresses that NIA is a new and separate entity both in the work created and the process by which this occurs.

"It's not a replica," he says. "I think fundamentally it's a different process. It's software development, not film development. There's a finite delivery in film that you're aiming towards - you deliver a film and it's finished. Whilst with a lot of the stuff that NIA's doing, delivery can be in several stages, it can be an ongoing thing. There's also obviously, prior to delivering, a lot of research and development."

Defining this new procedure, both to themselves and to agencies and clients, has occupied NIA for much of the last year. Unlike the fixed and long-established rules of engagement surrounding film production, interactive work demands an entirely different approach, which can vary from project to project, depending on the work being made. Not an easy notion to pin down, but essentially what is required is a move away from the pitch process - where a range of directors pitch their ideas for a project to an agency for free - to an earlier and deeper commitment from the client.

"It's very different in the interactive space," says executive producer Cedric Gairard. "The pitch process is in fact a research and development phase, which takes a lot of resources and demands much more time and commitment from the agency and client. Not just a commitment on time, but a commitment on budget as well, up front. There is a lot of production know-how and expertise that has to be put in up front."

The process is also different for the artists, who often take more of an authorial role than they may do on a typical commercial project. "I think they [the agencies] tend to look to us to help them author the experience," says O'Reilly. "So it's a collaborative thing: we understand what they're looking to do and we then come in and help refine what that can be. Obviously, as with animation, quite often the technical side of what is possible is sometimes driving where that story can go ... so it's very hard for an agency to sit there and write it all out perfectly."

For the artists, a major benefit of joining NIA is help in navigating the commercial world and dealing with ad agencies, an experience that may be unfamiliar and daunting. "The artists really understand that this is a bit of a moment for them," says Gairard. "There's very much a sense of brotherhood between all these artists, but yet each of them, having now developed their voice, does see that getting to the next level, and engaging with an agency, is a different ballgame to doing little projects and experimentation here and there. So from an artist's point of view, as well as from an agency's, working with NIA - and so with the Nexus label and the kind of guarantee of quality, understanding of process and management that offers - is a relief almost. The pressure is off their shoulders in terms of figuring it out. They can just be focused on the output, the creative and the objective that the agency needs to pursue, and lose a little bit of that logistical stress, production stress and financial stress."

Eclectic offering

NIA's output to date has been, unsurprisingly, eclectic. Wouters & Puckey created the charming One Frame of Fame website, an interactive video for the Dutch band Cmon & Kypski, which invites fans to play a starring role by uploading webcam images of themselves performing the moves portrayed onscreen by the band. The result is a constantly changing film that sees fans appear alongside the musicians. Hellicar & Lewis created a large-scale interactive installation for a rebrand of NZ Telecom that was displayed in Auckland, while Minivegas created audio responsive visuals for the Red Bull Music Academy 3D Soundclash between Warp and Ninja Tune, that was held at the Royal Albert Hall in London last year. NIA has also created a website and two iPhone apps for Tate, to accompany its Miroslaw Balka and Eadweard Muybridge exhibitions.

More exciting projects are to come during 2011, we are promised, with events including a live gaming project for a museum and a large-scale public installation for a brand in the pipeline. NIA is also developing a project for the 2012 Olympics, based less in commercial territory and more in fine art. So far, certain types of companies, especially art institutions, record labels and those in the fashion industry, have expressed particular interest in experimenting with interactive work, but it seems only a matter of time before other, more mainstream clients follow, as the work rolls out and the possibilities offered become clear. "Making things will teach us what really needs to be done," says Gairard. "You need to get to do it. You can do a lot of theory, you can draw a lot of scenarios but the experience is what's really going to pay off. People need to have the guts to go for it and make stuff."

A REPORT SAYS CHINESE FAMILY PLANNING OFFICIALS HAVE BEEN PROFITING FROM THE SALE OF BABIES.

WASHINGTON, DC -- The following information was released by Radio Free Asia:

Members of a family planning office in the southern Chinese province of Hunan abducted several infants in recent years and profited by putting them up for adoption, according to a report from a China-based online media group.

Caijing.com said in an article Monday that officials in Longhui county's Gaoping township had seized some 10 newborns between 2002 and 2005, selling them to a local welfare orphanage in Shaoyang city.

The report said the babies were then adopted by foreigners who paid as much as U.S. $3,000 for each child.

According to caijing.com, officials seized infants regardless of whether or not they had been born to families in violation of China's one-child policy.

In one 2005 abduction, the report said, a baby girl named Yang Ling was taken from her home by officials who said her parents had not paid a "social foster charge."

The girl's father, Yang Libing, had been working as a migrant worker in the southeastern city of Shenzhen at the time and said that it wasn't until four years later that he and his wife learned that their daughter had been adopted by a couple in the U.S.

The Caijing.com reporter declined to be interviewed when contacted by RFA, but said that the information on the U.S. adoption had been obtained through several conversations with Yang and his wife.

On Monday, the Caijing.com-affiliated weekly New Century also quoted Jiang Dewei, the head of the Shaoyang orphanage, as saying that 13 infants had been sent to the facility by Gaoping county officials from 2002 to 2005.

Jiang said that most of the children had passed a required government examination procedure and had been identified as "abandoned infants."

New Century also reported that Shaoyang city and Longhui county established a joint investigation team on Monday to look into the accusations.

Claims denied

When RFA contacted the provincial family planning committee in Hunan on Tuesday, an employee denied the claims made in the report.

"How can you trust what appears on the Internet? We are the government, no such thing has happened," the employee said.

A female staff member who answered the phone at the welfare orphanage in Shaoyang on Tuesday could not provide any details surrounding the case.

"I don't know, as it happened several years ago. I am a new hire here."

Chinese citizens and rights groups have responded angrily to the allegations, calling on authorities to punish the family planning officials as "human trafficking criminals."

"I hope the government will thoroughly investigate this case, and that the perpetrators will be brought to justice," said Zhang Zilin, a Hunan-based rights activist.

Gender imbalance

China's controversial "one-child" policy began in 1980 and has been blamed for triggering abuses.

Allegations of forced late-term abortions, forced sterilization, harassment, and even forced eviction have been allegedly committed by officials keen to meet strict family planning quotas and evade penalties.

Officials have even thrown some one-child policy critics behind bars, including blind Shandong-based legal activist Chen Guangcheng, one of China's most prominent rights campaigners.

Chen has been held at his home in Yinan county along with his entire family since his release in September at the end of a four-year jail term.

Chen was jailed for "obstructing traffic" after he angered local family planning officials by encouraging local people to complain about forced abortions, forced sterilizations, and other abuses under the policy.
